Grievance called in sick prior to the time that his shift was to start. Approximately 10:30 a.m., his wife called in and asked to speak to him. When told that he had reported in sick, the wife complained that he must be running around with some girl and the wife suggested that the supervisor see if he was at his girl friend's house and gave the supervisor an address. The supervisor notified personnel and personnel sent a visiting nurse to the grievance's house and an investigator to the girlfriend's address. The nurse found an empty house. The investigator found the grievance and girlfriend together at the girl friend's house. The company terminated the grievance who had a poor attendance record but who had no prior warnings or final warnings.
Section C. When it becomes necessary to discharge, give final warnings and suspensions against an Employee, the Company will notify a Union Steward and will have one present to hear the formal charge made against the Employee. If no Union Steward is present, the Employee involved may nam
e any Employee then at work in his department or in the plant to be present to hear the charges.
The grievance had receipts and documentation of storage rental.

An employee who will be absent from work for good and valid reasons must submit his request in writing and obtain approval from his department head as far in advance as possible. ...A scheduled Employee who is absent must notify his department head of his availability to return to work before 12:00 noon on the work day prior to the day he is able to return.
