New York Times vs. United States

The New York Times is a respectable newspaper, established in 1851 by Henry J. Raymond. It was taken over by Adolph S. Ochs in 1896 and his descendants still run it. The New York Times staff has won more Pulitzer Prizes than any other newspaper's staff. The newspaper is known today as one of the mainstays in the journalism world. The United States Government in the late sixties - early seventies was in a time of tremendous turmoil. The Executive branch under the direction of the Nixon Administration received lots of criticism for some of its dishonest policies and handling of the federal government. President Nixon however went on to resign due to the Watergate scandal, a scandal that tarnished his presidency forever.

The Pentagon Papers is a secret name given to a secret study done by the U.S. Department


The Justices on the case were Thurgood Marshall, Potter Stewart, Byron White, Harry Blackmun, John Harlan, Hugo Black, William Brennan, William O. Douglas, and Chief Justice Warren Burger. Justices Burger, Blackmun, and Harlan dissented while all others were in favor of The New York Times. The time constraint had a major effect on the ruling the ruling was made in 4 days, making it a dramatic decision made in little time. The Basis of the ruling favoring The New York Times was that Justices Black, Brennan, Douglas, White, Marshall, and Stewart believed that there should of never been a lower court ruling to stop the publication of the paper. In stopping the publication of the paper the government had infringed on the 1st amendment right of freedom of the press.
