Pros and Cons of Same-sex marriage

Same-sex marriages have become a central point of contention in contemporary society. There are numerous differing viewpoints on the subject. This paper outlines some of the most contentious and cardinal issues at stake in this debate. The paper attempts to cover the central problem areas and argues that same-sex marriage is essentially an issue that should be resolved on the basis of civil liberty and civil rights. The recognition of the constitutional rights of same-sex married couples should be recognized and protected under law.

Same-sex marriage has become a controversial debate in contemporary society. There are heated arguments for and against the legalization of marriage between couples of the same-sex. The underlying assumption for those in favor of gay marriages is that the central aspect of love, relationship and understanding should override all other issues. Others argue that there are numerous factors that militate against the acceptance of gay marriage as an institution in modern society.

The above points out clearly that same-sex couples often do not have the same rights as others. Added to this are other examples, such as legal difficulties that can ensue with regard of the drawing up of wills. "Upon death, in many cases, even very carefully drawn wills and durable powers of attorney have proven to not be enough if a family wishes to challenge a will, overturn a custody decision, or exclude us from a funeral or deny us the right to visit a partner's hospital bed or grave." (ibid) Another example given in this regard is the fact that partners in a same-sex relationship are not immune from testifying against each other in a court of law.

2.The rationale against same-sex marriage

Despite these findings there are still many people who have strong reservations about gay marriage and gay couples who rear children. A question that arises in the research about gay marriage is why such avid opposition to the idea of gay marriage continues to exist, even for those who do not oppose basic rights for gay people.

This leads naturally to a related reason for rejecting gay or same-sex marriages - namely the impact on children reared within this domestic situation. As one critic clearly states:"... it will do harm...because it is the most obvious and outrageous attack on what is left of marriage in America. (Card O.S.)
