Many issues and arguments arose before the beginning of the Civil War in 1961. The biggest issue of the war was slavery. The feeling of this issue was big enough to sectionalize the United States into two groups called the North and the South. What exactly caused the state to separate were the three issues; The Dred Scot Decision, Compromise of 1850 and John Brown's Raid on Harper's Ferry. Each issue pushed the country to turn against each other and lead it into war. These three incidents can be seen as a sign to the beginning of war. In 1834 a black man with the name Dred Scott (born in Virginia and raised in Missouri) was taken to the free states of Illinois and Wisconsin by his master. After taking Scott to the free states his master returned him back into the slave state of Missouri. Scott sued for his freedom stating since he had lived in a free state and in free territory then he should be a free man. His trial was named Scott vs. Sanford and raised many questions in the legal system. If Scott wasn't a citizen of the United States he may be able to sue in higher court. Also if Scott was a resident in free territory it could make him a free man although he was returned to a slave state. On March
On January 29, 1850 Henry Clay was called in to shape a compromise that the North and South could agree on. Because many Americans had relocated to California for the 1848 gold rush, California began to expand so much that it was clear California needed and was ready for statehood. If California became a state it would enter the Union as a free state. This made the South furious. If California became a free state Mexico would then follow. This then rioted the North, they thought the territories were unfair. Since California and Mexico are both in the north why shouldn't they be free states? Clay's proposal brought up many answers and reasons why the North wanted it this way. Clay's proposal was this; First California should be entered as a free state, and Utah should be separated from New Mexico. The two territories should be able to decide weather they wanted statehood or not. The land that Texas argued with Mexico over, should be given back to New Mexico and the United States should pay off all the debts that Texas had during annexation. With the issues of slavery in the District of Colombia, residents of Maryland should vote whether they want to abolish slavery. Slave trading in the Colombia District should be abolished. To keep most slaves from fleeing to freedom a stricter slave law should be issued which would provide recovery of runaway slaves and returned to their owners by federal marshals. John 6, 1857 Chief Justice Roger B. Tanny was handed the case. Roger Tanny claimed that blacks had never been called citizens either before or after the Constitution was made, therefore Scott should not be a free man. "Beings with inferior order with no rights which any white man is bound to expect." P.346 The court also ruled that being on free-land does not make a slave free. This ruling made all blacks non-citizens of the United States, but slavery is able to exist anywhere in the United States. This immediately upset the North and put the South in more control.
