Employers should not discriminate against people who have body piercings. Yes, this is a form of discrimination. An employer by not hiring a pierced person is ethically wrong. Employers who prohibit body piercing in the work environment are violating this right.

The idea that a person's job performance is affected by a body piercing is a poor assumption. It is like saying a person's hair color determines their intelligence. Employers are looking for honesty, integrity, ability to interact with others, and communication skills. How does a body piercing affect persons abilities?

Since the mainstream popularity of body piercing many companies such as Outback Steakhouse in Grand Rapids, Michigan and Blockbuster Video have changed their dress code policies to prohibit facial jewelry. They have a one-ear ring per ear policy for all employees and any other visible piercing is prohibited. Other companies such as Lexmark and Barry Bagels have no policy against piercings. Joyce Mckee from Lexmark's human resources department states "as long as it is not a safety issue or affects the person's performance it will not come up as an issue."2

"Employers have the right to establish dress codes that dictate the kind of image their employees project. But companies can't treat gender or races differently," said Janilyn Brouwer Daub, and attorney with Barnes & Thornburg. Therefore you can't allow women to have their ears pierced and not men. And to let women have more than one hole in their ear and not men is also discrimination3.
