Meriful Justice

Justice can only be just by being merciful. If the body in power was not merciful and punished the offenders with the same punishment for the same act of wrongdoing it can fail to be completely just. There are other variables that should be considered before deciding the punishment. The degree, to which a crime is committed, the number of times it has been committed, to whom it has affected, and under what special circumstances surrounds the crime, should be taken into consideration. Also if a punishment fails to achieve its goal of rehabilitation for one person, it should be taken into consideration that the punishment should be different for the next criminal who commits the same act of crime.

Claudio's circumstances were different than that of Angelo's. They both committed the crime of adultery, but is it fair that Claudio die as well as Angelo? Angelo committed it more than once, and the second time was out of lust rather than love. Claudio committed it out of love and did not commit it the same crime again with another woman. It is not fair that Claudio died for the same reason that Angelo would. Angelo's crimes were more severe, yet he still suffers the same fate as that of Claudio.

The mercy that Claudio did not receive was shown to Jean Valjean in the novel Les Miserables by Javert. Javert spares Jean Valjean's life because he saw that Jean Valjean is not the convict that he once was. Javert saw the virtuous things that Jean Valjean did and gave him mercy. But Javert was still having conflicts about giving Jean Valjean his freedom. Javert believed in set rules and applying them equally
