Hackers
Before I can discuss hackers, I must outline what laws they are seen to be breaking.Each different country has their own Computer laws, but all follow the universal code. This being the Data Protection Act (1998). The 1998 Data Protection Act came into force early in 1999 and covers how information about living identifiable persons is used. It is much broader in scope than the earlier 1984 act, but does contain provision for a transitional period to comply with the new requirements. The Data Protection Act, of course, is mandatory. All organisations that hold or process personal data must comply. The Data Protection Act contains eight Data Protection Principles. These state that all data must be: Processed fairly and lawfully. Obtained & used only for specified and lawful purposes. Adequate, relevant and not excessive. Accurate, and where necessary, Kept for no longer than necessary. Processed in accordance with the individuals rights. Transferred only to countries that offer adequate data protection.
It is commonly known that there are difficulties in the detection of hackers or other persons who commit computer crimes. A truly sophisticated intrusion leaves no track, no proof of a crime. On the other hand, how many crimes can be characterised as "perfect crimes?" Computer security industry knows that there is a huge number of "perfect crimes". If the crime cannot be perceived, with any evidence, the most likely possibility is to be overlooked. Another aspect of the problem is that companies, which are based on customers' confidence, are afraid to declare in public that are targeted by hackers. Perhaps, all these companies think that they may lose the customers' trust or to be accused of having inadequate security systems. http://www.hmso.gov.uk/acts/acts1990/Ukpga_19900018_en_1.htm In addition to this, companies have no confidence in the police, because they believe that police is inexperienced and unskilled in the field of computer crime: " In the UK, this might well be a fair perception: the numbers of computer specialist officers and of successful prosecution are very small. In the USA, it is less fair: the FBI secret service and military investigators have gained experience and capability very rapidly-and willing both to work with and to educate local forces".
