A detailed Summary of Torts


Story mainly points out negligence and it is what someone's failure to live up to a required duty of care, causing another to suffer injury. The breach of the duty must create a risk of certain harmful consequences, whether or not that was the intent. The elements of negligence are; duty of care, breach of duty of care, damage or injury as a result of the breach, and the breach causes the damage or injury.

In this case the gas station, Presidential Gas, Inc, owed a duty of care as a business invitee to Monica. The area where Monica slips on the spill which caused her to suffer a fractured ankle ?that is, gas station's parking lane ?is always exposed to high turnover rate of cars and occasional spills of gas and liquid from cars. The third element of negligence has now been occurred. An injury has been suffered by the plaintiff. The damage was indeed the causation of the breach. The second tort that comes in to my mind is where George assaulted Bill while he was waiting to pay his gas bill. Assault as a tort is an intentional act that creates in another person a reasonable apprehension or fear of immediate harmful or offensive contact. To attest assault requires plaintiff's suffering of apprehension due to defendant's act, and to verify battery requires the completion of the act, with motives proven or not, that caused the apprehension which brings to a case of Bill getting hit by the large size chocolate bar. There are some possible defenses for act of George; defense of others, consent, defense of property, and self-defense. But George had committed the tort of assault and battery and is liable to compensate Bill.
