In this case the gas station, Presidential Gas, Inc, owed a duty of care as a business invitee to Monica. The area where Monica slips on the spill which caused her to suffer a fractured ankle ?that is, gas station's parking lane ?is always exposed to high turnover rate of cars and occasional spills of gas and liquid from cars. To attest assault requires plaintiff's suffering of apprehension due to defendant's act, and to verify battery requires the completion of the act, with motives proven or not, that caused the apprehension which brings to a case of Bill getting hit by the large size chocolate bar. There are some possible defenses for act of George; defense of others, consent, defense of property, and self-defense. But George had committed the tort of assault and battery and is liable to compensate Bill.
