There is really no concrete way to tell if a judge is going to give the death penalty or not. There are fluctuations of thought as well as fluctuations of emotions in these decisions. There are also many other outside factors that plays a part in the death penalty. If a deal outside the courtroom is struck by both sides, a death penalty won't occur. Yes, you would need to have committed a capital crime in order to receive the death penalty, but this is the only criteria that has to be met. There are no other criteria that needs to be met.

However, this capital crime had to be brutal or extremely malicious to bring this wrath upon themselves. If they committed such a malicious crime, would it be right to let this person live on. I looked into the crime rates for capital crime and I see that California does indeed lead Texas in that category. How then did texas have 24 death sentences last year compared to 5 that Calfornia had? Isn't that an uneven sentences issued by different judges with different thinking and different emotions? I guess if I were ever to committ a crime I shouldn't committ it in Texas because the judges there are much stricter and will hand down a stronger sentence. Yes, there are procedures, but the Federal law offers the judge a great lee way into what his final decision would be. Emotions could be stronger in some areas and this can cause a difference or uneven sentence. The point that I am trying to get across to you is that different judges with different thoughts will rule differently. They all have choices that they will have to make. The point I am trying to convey here is that they have choices. This is the flaw, a choice will infer an uneven distribution of the death penalty. A choice will infer thinking and thinking will infer difference. This is the problem with the system today. Judges have too many choices to decide from these days and taking into consideration their own personal opinions and thoughts on the subject will will likely pick a verdict that they believe would be correct. No comes the hard part, morals. Not all judges have the same moral value and determination as other judges do. We can't expect all of them to because they are all different and they all come from different background. These background provide them with the moral values that they have today. So who is to say if one judge is right and the other judge is wrong. You can't and this will also cause a major fluctuation between the issuance of the death penalty.
