Equality
There is a danger to claim the idea of equality in a country where it does not exist. From the early settlement of Europeans in America to modern times the country has progressed prodigiously but it is still far from a land where all people are truly equal. The fact that the Court has divided different levels that treat people differently indicates that equality is merely an idea that America wishes all to perceive and not actually a working principle. At the bottom of the tier are those who are discriminated against their sexual orientation. Higher on the list is the immediate level where women are discriminated against. Finally, those who are discriminated upon their race are judged with the strictest scrutiny standard of review thus regarded more severely than any of the bottom two. The way that the Court has decided upon which class receives the most attention is in no ways related with who is more damaged. America claims to be a country where all are equal but, on the contrary, the small percentage of Americans who are gay continue to be discriminated against by not only ordinary citizens but the Courts as well.
