Contemporary Ethics About Sexual Harassment



             Enforcement of the laws prohibiting sexual harassment has been stepped up in the last few years. But in workplaces across America and the world, the issue is far from settled. Sexual harassment is still a daily problem for many workers, especially women. But what is sexual harassment? In legal terms, sexual harassment is any unwelcome sexual advance or conduct on the job that creates an intimidating, hostile or offensive working environment. In real life, sexually harassing behaviour ranges from repeated offensive or belittling jokes to a workplace full of offensive pornography to an outright sexual assault. The very first sexual harassment case, filed under Title VII, was decided by the court system in 1976. The following year, the court of Appeals for the D.C. Circuit became the first appearing court to find that sexual harassment was indeed sex discrimination. In 1986, ten years later, the Supreme Court ruled for the first time that sexual harassment was discriminatory under Title VII and held employees liable for the conduct of supervisory employees. In 1991, that calendars displaying photos of nude or scantily clad women that were hung around a shipyard constituted harassment of female employees, and ordered the shipyard the shipyard"s owner to remove them. The 1993 Supreme Court"s decision replaced "reasonable woman standard". In this 1993 decision, the Court established that plaintiff-employees who bring a sexual harassment claim against a company asserting a hostile work environment do not need to show that they suffered serious psychological injury; they must only show that the workplace was reasonable seen as hostile or abusive. In September 1994 a federal jury in San Francisco awarded Rena Weeks, a former secretary for Baker & McKenzie, the nation"s largest law firm, $7.1 million in damages in a case of hostile-environment sexual harassment. The jury concluded that Week"s employers knew she was being harassment by a partner in 1991 but did nothing to stop it.
